Step-by-step guide: Letters of Verification

In this blog, we’ll cover a rarer type of file that falls under the “Non-Contentious Procedures” category: “Letters of Verification” and what the process is at Services Parajuridiques Peggy Mavroudis in preparing and executing this type of file for a client.


Also referred to as “Letters of Administration”, this procedure is often required when a Deceased held assets outside of the Province of Quebec. In those cases, certain institutions or authorities may request for the notary in Quebec to issue “Letters of Verification“ or “Letters of Administration” to prove outside of Quebec, for example, who the liquidator or legatees are of the Deceased's succession.



First thing's first


Once the notary has been contacted by their client and has received all the necessary documentation, Services Parajuridiques Peggy Mavroudis gets mandated and we are ready to begin.


First, we will carefully review the requirements of this foreign institution or authority as they are often quite complex and different from our procedures and laws here in Quebec, as well as, review the death certificate, will searches and will (unless the Deceased died ab intestate).


Second, the drafting begins. We will draft the complete procedure from A to Z, namely:


  • Application to the Notary

  • Notice of the Application

  • Minutes of Operations and Conclusions

  • Letters of Verification

  • Notice of Filing of the Minutes of Operations and Conclusions

  • Backings


These are drafts, meaning the notary will review and complete certain information as the proceedings and delays move along. The notary is now ready to book their appointment with the Applicant and officially begin the proceedings.

Should the notary require, we offer the following additional services in executing these types of files, specifically:


  • Depositing the “Application to the Notary” and “Notice of the Application” at court via Lexius to obtain the court number;

  • Notifying the parties via Todoc;

  • Depositing the “Minutes of Operations and Conclusions” and the “Letters of Verification” at court via Lexius;


Furthermore, we can communicate directly with the Applicant to obtain any missing information so as to alleviate the notary from such tasks.
